01 Introduction

This website (the "Site") provides information, products, and services relating to real estate (the "Services") offered by BrookHaus Capital ("BrookHaus Capital," "we," "us," or "our"). We operate this Site and may engage third-party contractors to help us deliver the Services and run the Site ("Service Providers").

If you visit this Site, this Privacy Policy & Terms of Use applies to you. It explains how we collect, use, and disclose your personal information in connection with your use of the Site. We act as the controller of your personal data, and our Service Providers assist us strictly in their capacity as processors acting on our behalf.

This document does not apply to any website, application, or online service that does not link to it — including other services operated by us or by our Service Providers. 02 Information We Collect

We collect information from you in a number of ways when you access or use the Site or otherwise engage with the Services.

Information you provide to us

This includes contact details you give us — such as your first and last name, email address, mailing address, and phone number; any feedback or correspondence you send when you contact us with questions or comments; your marketing preferences and consents, along with details about how you engage with the communications we send; and any other information you choose to share or that is needed in the course of your interactions with us through the Site or Services.

Information we obtain from third parties

Social media. We may maintain pages on platforms such as Facebook, LinkedIn, and Instagram. When you visit or interact with those pages, the platform's own privacy policy governs that activity and its handling of your information. Anything you or the platform shares with us through these channels will be treated in line with this Policy.

Data enrichment. We may supplement what we know about you with information from third-party providers — including property and public records databases, demographic and behavioral data sources, publicly available social media profile information, and other commercially available datasets — to make our services and communications more relevant.

Other sources. We may receive your personal information from other third parties, such as analytics services, marketing partners, publicly available sources, and data providers.

CRM and communication data

If you communicate with us by email, text message, or other electronic means — or where we use customer relationship management ("CRM") tools to organize our interactions with you — we may collect and process the content, headers, metadata, and attachments of email messages; the content and metadata of text messages; timestamps, read receipts, and delivery status; your contact details and communication history; and notes or records relating to our dealings with you.

Our CRM tools may sync with email accounts to help us manage communications. Where email synchronization is enabled, information from messages exchanged with you — including content, sender and recipient details, timestamps, and attachments — may be processed and stored to help us serve you better, keep accurate records, and follow up appropriately.

Information collected automatically

We and our Service Providers may automatically log information about you, your device, and your interactions over time with our Services and communications. This includes device data (such as operating system type and version, device manufacturer and model, browser type, screen resolution, device type, IP address, unique identifiers, language settings, mobile carrier, and approximate location such as city or region) and activity data (such as the pages or screens you view, how long you spend on them, your navigation paths, access times and durations, and whether you opened our emails or clicked the links inside them).

To collect this information we use cookies (small text files stored on your device to recognize your browser or hold settings), local storage technologies (which work like cookies but can hold more data), and web beacons (also called pixel tags or clear GIFs, used to confirm that a page or email was opened or that certain content was viewed or clicked).

03 How We Use Your Information

We may use your personal information for the following purposes:

  • To provide and operate the Site and Services — including to run and improve them; to send announcements, updates, security alerts, and administrative messages; and to respond to your requests, questions, and feedback.
  • To manage our relationship with you — using CRM tools to keep records of our communications, track your preferences and interests, and provide personalized service, which may include analyzing your interactions to better understand your needs.
  • To send follow-up communications — where you have opted in, we (or our Service Providers) may from time to time contact you as permitted by law, including by phone, email, and SMS, some of which may use an automated or prerecorded voice. You can opt out as described in Your Choices & Opt-Outs.
  • To send marketing and promotional communications — where you have opted in, we may send direct marketing as permitted by law through the same channels. Except as described in How We Share Your Information, your information is not shared with third parties for their marketing. You can opt out at any time.
  • To comply with law — where we believe it necessary or appropriate to meet legal obligations, lawful requests, and legal process, such as responding to subpoenas or government requests.
  • For compliance, fraud prevention, and safety — to protect the rights, privacy, safety, or property of BrookHaus Capital, you, or others; to enforce the terms governing our Services; and to detect, investigate, and deter fraudulent, harmful, or unauthorized activity.
  • To create anonymous data — we may remove identifying details to create anonymized data, which we may use and share for lawful business purposes such as analyzing and improving the Services, conducting research, and promoting our business.

04 Use of Artificial Intelligence

We use artificial intelligence ("AI") and machine learning to deliver and improve our Services. This section explains how.

AI-generated content

We may use AI to create, assist with, or enhance content on the Site or within our Services — including property descriptions and listing details, articles and other written content, social media posts and marketing materials, email communications, and advertising copy. AI-generated content is produced using large language models and other machine learning systems. Although we review such content for accuracy and appropriateness, it may still contain errors or omissions. You should not rely on AI-generated content alone for important decisions, including real estate transactions, without independent verification.

AI-assisted communications

We may use AI to help with communications — for example, to draft and suggest responses, analyze communication patterns to improve service, provide automated answers to common questions, and prioritize or categorize incoming messages. A person may review and approve messages before they are sent, although some automated responses may go out without individual human review.

AI-based analysis and recommendations

We may use AI to analyze data and generate recommendations — such as identifying opportunities based on your stated preferences and behavior, suggesting properties that may fit your criteria, analyzing market trends, and optimizing the timing and content of communications. These outputs are provided for informational purposes only and are not professional advice. Important decisions should be made with qualified professionals.

Your rights regarding AI

You may request information about whether AI was used to generate specific content, ask for human review of significant AI-assisted decisions, opt out of certain AI-powered features where technically feasible, and give us feedback on AI-generated content or recommendations. 05 How We Share Your Information

We do not "sell" personal information as that term is defined under applicable laws. We may share your personal information as described below and elsewhere in this Policy, with:

  • Our team, partners, and affiliates — our employees, contractors, partners, and affiliates, including to facilitate your interactions with us.
  • Our Service Providers — companies and individuals that perform services on our behalf, such as hosting, IT, CRM, email delivery, AI and machine learning services, and website analytics.
  • Professional advisors — such as lawyers, accountants, auditors, bankers, and insurers, where needed for the professional services they provide to us.
  • For compliance, fraud prevention, and safety — for the purposes described in the section above.
  • Business transfers — in connection with a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, or similar transaction (or potential transaction), in which case we will make reasonable efforts to require the recipient to honor this Policy.

Other than as set out here, your information is not shared with third parties for their marketing purposes. We will never disclose personal information such as phone numbers or SMS consent to any third party for marketing purposes.

06 Advertising & Tracking Technologies

We may use advertising and tracking technologies to deliver relevant advertising and measure how well our marketing performs.

Third-party advertising platforms

We may share certain information with advertising platforms such as Meta (Facebook/Instagram), Google, and other ad networks in order to deliver ads tailored to your interests, measure campaign effectiveness, build audiences of similar users ("lookalike audiences"), and track conversions. When you interact with our Site, these platforms may collect information through cookies, pixels, and similar technologies, which may include device identifiers, browsing behavior, and your interactions with our ads.

Tracking pixels and conversion events

We use tracking pixels (also called web beacons or clear GIFs) to understand when you view or interact with our content, measure the effectiveness of our email campaigns, attribute conversions to specific campaigns, and analyze behavior on our Site. These technologies may transmit information to third-party platforms, including which pages you visit, the actions you take, and details about your device.

Interest-based advertising

We take part in interest-based advertising, which means you may see our ads on third-party sites and platforms based on your browsing behavior and inferred interests. Those platforms use cookies and similar tools to gather information about your activity across different websites and services in order to show you more relevant ads.

07 Your Choices & Opt-Outs

Online tracking opt-out

You can limit the collection of your online activity and device data in several ways: block or remove cookies through your browser settings (for guidance, including how to view and delete cookies, see allaboutcookies.org); limit use of your mobile advertising ID in your device settings; and use privacy-focused browsers or plug-ins such as Brave, Privacy Badger, DuckDuckGo, Ghostery, or uBlock Origin.

Platform opt-outs

Several advertising partners let you opt out of interest-based advertising directly: Google, Facebook, and X (Twitter).

Industry opt-out tools

You can also use industry tools to limit interest-based advertising from participating companies: the Digital Advertising Alliance and the Network Advertising Initiative. Because these mechanisms are specific to each browser or device, you will need to opt out on every browser and device you use.

Do Not Track

SMS opt-out

To stop receiving SMS messages from us, reply STOP to any text we send.

Email opt-out

You can unsubscribe from our marketing emails at any time using the unsubscribe link included in each message.

Your privacy rights

Depending on where you live and the nature of your dealings with us, you may have the right to: learn how we have collected and used your personal information (much of which is set out in this Policy); access a copy of the personal information we hold about you, where applicable in a portable, machine-readable format; correct information that is inaccurate or out of date; request deletion of information we no longer need; and, where applicable, object to or restrict certain uses of your information or withdraw your consent. 08 Data Retention

We keep personal information for as long as necessary to fulfill the purposes for which it was collected — including to meet legal, accounting, or reporting requirements and to provide the Services. How long we retain it depends on the context and our relationship with you: contact details and communication records are generally kept for the duration of our relationship and for a reasonable period afterward; CRM data, including email synchronization data, is kept while you maintain an active relationship with us unless longer retention is required by law; transactional records may be retained to satisfy legal and regulatory obligations; and marketing preferences are kept until you update them or opt out. When information is no longer needed, we securely delete or anonymize it, though we may retain anonymized or aggregated data for analytical purposes.

09 Third-Party Services

The Site and Services may contain links to websites and online services operated by third parties, and our content may at times appear within third-party pages. These links and integrations are not an endorsement of, or a representation that we are affiliated with, any third party. We do not control third-party sites or services and are not responsible for their actions or their privacy practices.

10 Security

We use a range of technical, organizational, and physical safeguards designed to protect the personal information we collect, applying measures appropriate to the level of risk involved in processing your data and following generally accepted industry standards both in transit and in storage. That said, no method of transmission over the Internet or of electronic storage is completely secure, so while we work to protect your information using commercially reasonable means, we cannot guarantee its absolute security.

11 Children

Our Services are not intended for children under 18 years of age. If we learn that we have collected personal information through the Services from a child under 18 without the consent of a parent or guardian where required by law, we will delete it.

12 SMS Text Messaging Terms

Use of SMS messaging

We use SMS text messaging to confirm appointments, send reminders, and notify clients of schedule updates or other important changes.

Unsubscribing

You can cancel the SMS service at any time by texting STOP. After you do, we will send one message confirming that you have been unsubscribed, after which you will no longer receive texts from us. If you would like to rejoin, simply sign up again as you did the first time.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Frequency and rates

14 Changes to This Policy

We may update this Privacy Policy & Terms of Use from time to time. If we make material changes, we will let you know by updating the "Last updated" date above and posting the revised version on this Site.

15 Notice for California Residents

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), gives you certain rights with respect to the personal information we may have collected about you.

Categories of information collected

In the preceding 12 months, we may have collected the following categories of personal information: identifiers (such as name, email address, phone number, and IP address); commercial information (such as property preferences and transaction history); internet or network activity (such as browsing history and interactions with our Site); geolocation data (such as the city and state derived from your IP address); professional or employment-related information (if you provide it); inferences drawn from the above (such as preferences and characteristics); and sensitive personal information (only where you provide it voluntarily, such as account credentials).

Right to know

You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, our business or commercial purposes for collecting it, the categories of third parties with whom we share it, and how long we retain it. We are not required to respond to more than two such requests in a 12-month period.

Right to delete or correct

You may request that we delete personal information we have collected about you, or correct inaccurate information. Upon receiving a verifiable request, we will do so unless an exception applies under law.

Authorized agents

You may use an authorized agent to submit requests on your behalf. We may require written permission and may ask you to verify your identity directly with us.

How to submit requests and our response

You may submit requests to know, delete, or correct by emailing info@brookhauscapital.com or by writing to the address in the How to Contact Us section. We may ask for additional information to verify your identity, which we will use only for that purpose. We will acknowledge your request within ten (10) business days and, subject to verification, respond within 45 calendar days; if we need more time (up to 90 days total), we will let you know in writing. Our disclosures will cover the 12-month period before we received the request, and we do not charge a fee unless a request is excessive, repetitive, or manifestly unfounded.

Right to non-discrimination

You have the right not to be discriminated against for exercising any of your California privacy rights.

Selling and sharing of personal information

California law places obligations on businesses that "sell" personal information or "share" it for "cross-context behavioral advertising." We may "share" certain information (such as device identifiers and browsing activity) with advertising partners for cross-context behavioral advertising as described in Advertising & Tracking Technologies, and you have the right to opt out of that sharing by contacting us. We do not "sell" personal information as that term is defined under the CCPA.

Sensitive personal information

The CCPA gives consumers the right to limit the use of their sensitive personal information to certain purposes. We do not request sensitive personal information in connection with the Site, other than account credentials used solely to provide and secure your account.

Do Not Track and Global Privacy Control

We do not track Site users over time and across third-party websites to provide targeted advertising, and we do not respond to browser "Do Not Track" signals. We do, however, honor Global Privacy Control (GPC) signals as valid opt-out requests under the CCPA.
